TERMS & CONDITIONS.

DRAFT FOR LEGAL REVIEW · Updated October 8, 2026

These draft terms describe Mountain Training’s online coaching services, formerly offered under the name Vancouver Island Mountain Training. They should be reviewed by a qualified British Columbia legal professional before being used as a client agreement.

1. Our services and your agreement

Mountain Training provides personalized fitness and endurance coaching. Your selected package and written enrollment confirmation define the services included. Online coaching is not medical care, rehabilitation, live safety supervision or technical guiding. Guided trips and courses booked through VIBE Backcountry Education are governed by its separate agreements.

2. Eligibility and accurate information

You must be at least 18, or have a parent or guardian’s written consent and our approval before enrolling. Provide accurate contact, training and relevant health information, and tell your coach when circumstances change. Coaching may be adapted or declined where it cannot be delivered appropriately.

3. Health and participation

Consult a qualified healthcare professional before beginning training if you have medical concerns, symptoms, an injury or uncertainty about exercise suitability. Follow any medical restrictions and share relevant limitations with your coach. Stop exercising and seek appropriate care if you develop concerning symptoms. Nutrition guidance is general education, not medical nutrition therapy.

4. Monthly fees and billing

Current monthly prices are Basecamp Training: $150 CAD; Ridge Training: $200 CAD; and Summit Performance Coaching: $275 CAD. Any applicable taxes, payment arrangements and billing date will be confirmed at enrollment. Where you authorize a recurring subscription, payments are charged monthly on the agreed billing date until canceled. We will give at least 30 days’ notice before a fee increase applies to your subscription.

5. Cancellation, refunds and payment failures

Cancel by written notice to VImountaintraining@gmail.com at least seven days before your next billing date to avoid the next charge. Later notice takes effect for the following billing cycle. The current billing period is generally non-refundable, except where required by applicable law. Medical emergencies or exceptional circumstances may be considered individually. If payment fails, we may pause coaching after notifying you until payment is resolved. No term removes mandatory consumer rights.

6. Risk and personal responsibility

Exercise and mountain activities involve risks, including injury, illness, changing weather, difficult terrain and wildlife. You are responsible for choosing appropriate terrain, equipment and companions, reviewing conditions and using qualified instruction where needed. A training plan, route suggestion or recorded activity is not a safety clearance or a guarantee of performance. Coaching cannot guarantee an injury-free outcome.

7. Liability and separate activity agreements

Nothing in these terms excludes liability or rights that cannot legally be excluded. Any limitation of liability or activity-specific waiver must be separately reviewed, clearly disclosed and agreed where legally required. These website terms do not serve as a blanket waiver of negligence claims. In-person guided activities may require additional participant agreements.

8. Equipment and scheduling

Use suitable equipment and clothing for your sessions, and inspect it before use. Device integration depends on your watch and platform compatibility. Equipment rental is not included unless agreed separately. If we arrange an outdoor session, weather or safety concerns may require changes or cancellation. For a session canceled by us, we will offer a suitable reschedule or refund for the affected service, subject to the agreed booking terms.

9. Training materials

Training plans and original coaching resources are supplied for your personal use. Do not redistribute, sell or commercially reuse them without written permission. Third-party materials and brands remain the property of their respective owners.

10. Privacy and third-party platforms

We use information you provide to answer inquiries, deliver coaching, process billing and review training. Services such as Framer, TrainingPeaks, WhatsApp and payment providers may process information under their own terms and privacy policies. Do not send sensitive medical information through public or general inquiry channels. A separate privacy notice identifying actual data practices must be finalized before launch.

11. Changes and resolving concerns

Contact us first so we can try to resolve a concern fairly. Mediation may be considered by mutual agreement; these terms do not prevent either party from exercising legal rights. British Columbia and applicable Canadian law govern, subject to mandatory protections in your jurisdiction. Material changes to active coaching terms will be communicated in advance and applied consistently with applicable law.
